These Terms of Service ("Terms") govern your access to and use of SoundsCare, a platform owned and operated by CHEPKOSIOM GROUP ("SoundsCare", "the Company", "we", "us", or "our"), including our website, mobile applications, and related services (collectively, the "Platform"). By creating an account, browsing, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Platform immediately.
1. Acceptance of Terms
By creating an account and using SoundsCare's Platform, you accept and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and CHEPKOSIOM GROUP, the owner and operator of SoundsCare.
BINDING AGREEMENT
2. Eligibility
To use SoundsCare, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding contract
- Not be barred from using the Platform under applicable law
- For worker/employee accounts, be physically located in a supported East African region at the time of registration
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to:
- Provide accurate, current, and complete information during registration
- Keep your password secure and not share it with anyone
- Notify us immediately of any unauthorized access or suspected breach of security
- Accept responsibility for all activity that occurs under your account
- Comply with all applicable local, national, and international laws and regulations
SoundsCare is not liable for any loss or damage arising from your failure to comply with these obligations.
4. Employer Obligations
If you register or use SoundsCare as an employer, you additionally agree to:
- Provide truthful information about your household, business, or organization
- Treat workers engaged through the Platform fairly, lawfully, and with dignity
- Comply with applicable labor laws, including minimum wage, working hours, and safety requirements in your jurisdiction
- Not use the Platform to solicit unpaid, exploitative, or unlawful labor arrangements
- Pay agreed wages and any applicable Platform fees in full and on time
- Report any workplace incident, dispute, or safety concern to SoundsCare promptly
5. Employee / Worker Conduct
As a SoundsCare worker user, you agree to:
- Maintain professional conduct in all interactions with employers and other users
- Respect client privacy, property, and confidentiality
- Complete assignments with integrity, honesty, and reasonable skill and care
- Report any disputes, safety concerns, or policy violations promptly
- Comply with all applicable safety, health, and immigration regulations
- Provide accurate credentials, identification, and references during verification
6. Fees, Payments & Refunds
SoundsCare may charge service fees for certain features, including but not limited to interview facilitation fees, profile placement fees, and premium listing fees. All fees will be clearly disclosed before you are asked to pay.
- Fees are generally non-refundable once a service has been rendered (e.g., an interview has taken place)
- Refunds may be considered on a case-by-case basis where SoundsCare fails to deliver a paid service due to our own error
- Payment processing is handled by licensed third-party payment providers (e.g., mobile money and card processors); SoundsCare does not store your full payment card details
- You are responsible for any taxes applicable to payments made or received through the Platform
7. Prohibited Activities
You agree not to:
- Use the Platform for any illegal, fraudulent, or unauthorized purpose
- Harass, threaten, discriminate against, or abuse other users
- Attempt to bypass, disable, or interfere with security measures
- Distribute malware, spam, or malicious code
- Infringe upon the intellectual property rights of SoundsCare or third parties
- Engage in fraud, misrepresentation, or identity deception
- Circumvent Platform payment mechanisms to avoid applicable fees
- Scrape, harvest, or extract data from the Platform without authorization
- Post false, misleading, or defamatory reviews or content
Verification Required: SoundsCare reserves the right to verify all user information, conduct identity and background checks where applicable, and validate qualifications to ensure Platform safety and quality. Providing false information during verification may result in immediate account suspension.
9. Intellectual Property
All content on the Platform, including but not limited to the SoundsCare name, logo, design, text, graphics, and software, is the property of CHEPKOSIOM GROUP or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Platform content without our prior written consent. Content you submit (such as reviews, profile information, or messages) remains yours, but you grant SoundsCare a non-exclusive, royalty-free license to use, display, and distribute it as reasonably necessary to operate the Platform.
10. Limitation of Liability
SoundsCare is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee the accuracy, reliability, or conduct of any employer or worker on the Platform. To the maximum extent permitted by law, CHEPKOSIOM GROUP and its officers, employees, and agents are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of income, property damage, or personal injury arising from an employment relationship formed through the Platform.
11. Indemnification
You agree to indemnify and hold harmless CHEPKOSIOM GROUP, its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
SoundsCare reserves the right to suspend or terminate your account, with or without notice, if you violate these Terms, engage in prohibited activities, or if we reasonably believe your continued use poses a risk to the Platform or its users. You may also close your account at any time by contacting support. Termination does not relieve you of obligations incurred prior to termination, including outstanding fees.
13. Dispute Resolution & Governing Law
These Terms are governed by the laws of the Republic of Kenya. Before pursuing formal action, we encourage users to contact our support team to resolve disputes informally. Where informal resolution fails, disputes may be referred to mediation or arbitration in Nairobi, Kenya, in accordance with the Arbitration Act (Kenya), except where applicable law grants you a non-waivable right to bring a claim before a court or regulator.
14. Force Majeure
SoundsCare will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, power or internet outages, government action, labor disputes, or public health emergencies.
15. General Provisions
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SoundsCare regarding your use of the Platform.
- Assignment: You may not assign your rights under these Terms without our consent; we may assign our rights to an affiliate or successor entity.
- Amendments: We may update these Terms periodically. Material changes will be communicated via the Platform or email. Continued use after changes take effect constitutes acceptance.

- Usage Data: Pages visited, features used, time spent, and interactions with the Platform

Our geolocation system verifies your location during registration. Registration attempts from outside these regions may be blocked for compliance, safety, and operational reasons.
